Reason 18 - Your Agent Helps You Look Into Complications in Property Documents
While a comprehensive examination of a real estate property title is primary important thing to do before considering at buying it, you need the help of a professional partner to help you on this. This is not simple, though. There are a lot of complications to sort out to make sure that you are given the right title of a property. Three things that should be present in title document: possession, right of possession, and the right of property.
If have already bought or invested in the real estate industry before, this may not sound foreign to you anymore. However, extra detail in searching the original copy of the property title and the specifications of its ownership structure should be carefully done professionally and only by the partner or your trusted real estate broker. Whenever possible, find out the history of ownership involved and the identities of the current owner or owners (if it is owned by several persons, not just one).
Surely, there are many document-related complications that you may encounter along the way. Careful study and meticulous review of the land or property title, however, will protect your investment. Otherwise, you might be facing disputes and other civil cases if a careless title search was conducted.
Although finding the title of property is an obvious requirement, there are people who don’t have any idea how the property title can be reviewed and how to determine if it’s the real title or a fictitious one. In this case, you need to engage the service of a professional—a real estate agent—who is skillful enough to determine the authenticity of a property title document. After all, this is his “bread and butter.”
After checking the authenticity of the title document, it is also very important to discover the specific details underneath. Some titles without your knowing may have complicated issues that can only be clearly understood by partners in the field. These issues include jointly-owned titles, transferring of ownership only—not the title itself, and other complications.
Once again, take note the importance of the three basics in acquiring a property title: possession, right of possession and the right of property.
When these three are present and well explained to you by your agent, you are assured of a worry-free property title. The term “possession” indicates the holding of the property while the “right of possession” is the evidence stipulated by law to prove that you possess the property (legally), and the right of property provides you a protection if, in any case, another claimant will emerge and demand his right as owner.
In real estate careful examination in the title deed is very important. Do not pursue a transaction without resolving any questionable matters on the title, its legal transfer, and other mentioned fundamentals.
